hi guys, any help with a matter that was withdrawn from accuser and paper to prove this and it was cancelled at police station.jSo when my frind gets to court after waiting for 4hours the judge said going to be referre to courst 5 instead of that busy court3. Why? I thought if matter dismissed from plaintiff the matter will be over. Not so it seems. why another date, no lawyer as they charge too much but state attorney has been appointed,i still ask Why? thouogt if withdrawn why have to go back again. Info if any please? must be some lawyer punters?? thanks S

Well the accuser might have withdrawn however the State still feels there is a case to be answered for and the state is proceeding. Very likely with the accuser as witness

But i would havethought if the accuser withdrewand signed all at the police station that that peice of paperwould in in the docket and the judge can look at it and see for himself that the accused withdrew. So not understanding this at all. Now the Judge thinks the person is so bad and sending him for trial. Its completely wrong,by withdrawing from the case surely it should have been thrown out??

Maybe said differently there were two cases one from the accused one from the state who has a vested interest that right is done. One is withdrawn the other proceeds. Typically the other way is the state refuses to prosecute then the individual takes civil action
