Secondly - Who determines if they are innocent or guilty? Do we rely on our Constitution Court or go the American way and have a Jury of our Peers? Either way it is fraught with misgivings.

I would rather see that current convicted criminals are relieved of some of their current rights, that is the right to vote. For F*&k sakes, these bastards have raped, killed and beaten the shit out of people and they are allowed a say in how our country is run. To me that is bullshit! They are housed, clothed and fed when we have a social problem we cant handle.

When all are truly as equal as possible and history is never forgotten but,not repeated...then a police, the keepers of citizens right to safety and security would do their job.

No. This country is not ready for the death penalty.

It needs to first understand the basic right to life before it can pass judgement on another's life and why the death penalty should be implemented.

I get why you would say that, but on some fundamental level you have to know that that will never yield justice.

Yes - you take a life you should be forfeit your own.

It's not automatic execution the next day. There would be a means of appealing before it's implemented.
The SA judicary is/was under"pressure" and possibly always will be from various sources and haven't buckled yet, excluding one or two bad apples .... there is a means to appeal against their judgements!!!

Unfortunately there is no Utopia and societies will not be equal for a long time. It does not however say the penalty cannot be introduced ...

It's definitely not going to be a deterrent because our criminals are not capable of thinking that far ahead. It might help to reduce the number of prisoners in out overburdened prisons.

The only issue is that our criminal justice stream is so ineffective that a few innocent people might get the chop and some who deserve to get the chop will get away.

For it but only certain crimes like first degree murder and rape of minors.

Than it's possible that 2 criminals, who commit the same crime will have different fates. Making it unfair to one or the other.

Death penalty for corrupt ministers, that's would be interesting.

We can have all the fancy laws and constitution but the problem is those that enforce it.

Like the state capture report went to the president (ANC head chief), so we asking the ANC to be the refree of the ANC, and now the refree is also in hot seat with his 4 million USD missing from his home.

The takeaway from all legal systems should be that justice necessarily has to be predisposed to dispassion in the application of judgment, sanction or penalty.

I think considering the challenges it invariably faces, it is amazing that any legal system can survive or in fact, be just.
